A Call from The European Alliance in Defence of Palestinian Detainees
Nearly 500 Palestinian administrative detainees in the prisons of the Israeli occupation authorities announced their decision to refuse to appear before the occupation courts, at the beginning of 2022.
This firm decision came as a response by these detainees to the occupation authority's practice of an arbitrary law, the Administrative Detention Law, especially.
After the Israeli courts proved that they are part of the occupation system that legitimizes its illegal procedures and provides cover for them, and does not meet the standards of fair courts, this decision was preceded by 6 administrative detainees declaring an open hunger strike for long periods, with the aim of forcing the prison authorities to release them or setting a limit on the length of their illegal detention.
Administrative detention is arbitrary detention that gives the Israeli occupation authority the right to arrest any Palestinian man or woman without his knowledge of the accusation and to imprison him for a period of up to six months, subject to extension. During the period of detention, which may sometimes reach years, the detainee is not charged with a specific charge and without being brought to court to defend himself.
The occupying power has made extensive use of this law, which dates to the period of the British Mandate for Palestine. Since the beginning of the Israeli occupation of the West Bank and Gaza Strip areas, the occupation authority has issued nearly 54,000 arrest warrants or renewed administrative detention, and during this year 2021, nearly 1,595 arrest warrants have been issued or the extension of administrative detention.
To confront this practice in violation of international conventions and the rules of international humanitarian law, the Palestinian administrative detainee has no choice but to announce an open hunger strike, endangering his life, to force the occupation authority to specify the duration of his detention and thus release him at a specific time.
With 500 Palestinian administrative detainees announcing their decision not to appear before the military occupation courts at the beginning of the new year 2022, we, the signatories to this statement, affirm our support for the struggle of these prisoners and support all the prisoners of Palestine until they attain their freedom. We call on all international human rights institutions, especially the Human Rights Council in Geneva, and the parliaments of European countries, and in particular the European Parliament, to take a clear position on this arbitrary practice of using the law of arbitrary administrative detention by the occupying power and forcing Israel to stop using it. We also call on all organizations supporting the rights of the Palestinian people to express their solidarity with more than 500 Palestinian administrative detainees so that they can attain their freedom.
Finally, we demand the release of all Palestinian detainees, children, the sick, the elderly, and women.
All support for the Palestinian administrative detainees in their struggle and their decision to refuse to appear before the occupation courts!
